SURECIRCLE Priority Order Care Service Agreement

Thank you for selecting our Priority Order Care Service (“Service”). This Service is designed to provide you with an expedited post-sales resolution experience for your purchases with the online store, brand, or e-commerce retailer from which your order was placed (“Merchant”).

IMPORTANT DECLARATION OF NATURE AND RIGHTS

  1. Nature of the Service: This Service is a commercial fulfillment enhancement, transit monitoring service, and priority delivery guarantee provided directly by the Merchant and administered by SureCircle. It constitutes a direct commercial service agreement, not a policy of insurance. Your contractual rights and remedies under this Service run solely against the Merchant as facilitated through SureCircle’s administrative service portal.
  2. Independence of Statutory Rights: Under applicable consumer protection laws, the Merchant bears fundamental legal responsibilities regarding the delivery of conforming goods. This Service operates supplementary to, and does not replace, limit, or diminish, any non-waivable statutory consumer rights or legal warranties provided under applicable law.
  3. Value Proposition: Enrolling in this Service provides access to an expedited resolution channel with an accelerated verification process. In the event of qualified transit damage or transit loss, you receive priority reshipment or monetary reimbursement without having to wait for the conclusion of lengthy logistics investigations. Orders dispatched without this Service remain subject to standard carrier fulfillment timelines and mandatory logistics inquiry cycles.

DEFINITIONS

  1. Priority Care Fee: The non-refundable service fee paid at checkout to secure expedited transit monitoring and priority resolution privileges under this Agreement.
  2. Priority Care Parcel: A package containing items associated with an order for which the Priority Care Fee has been paid, and which has been verified as received into the custody of an approved courier for delivery to the designated Delivery Address.
  3. Total Transaction Value: The actual net amount paid by you for the merchandise in the Priority Care Parcel plus the original standard delivery fee paid as reflected on the checkout invoice, subject to a maximum reimbursement limit of GBP £5,000 (or local currency equivalent) per parcel.
  4. Scheduled Delivery Date: The estimated delivery date established between the Merchant and you upon order confirmation, as updated by any agreed modifications.
  5. Expedited Resolution Request: A formal priority service application submitted through our designated administrative portal reporting a qualifying transit issue.

SCOPE OF CARE

Subject to the terms and exclusions herein, during the transit window commencing upon physical custody handover to the courier and concluding upon delivery, the Service provides the following remedies:

  • Transit Damage: Physical harm sustained by the contents of the parcel during transit that materially impairs core functionality or resale value. Damage confined strictly to outer packaging, surface blemishes, minor cosmetic scratches, or markings that do not impair operational utility are excluded. Where damage is partial or cosmetic and the product remains fully functional, a proportional partial reimbursement may be extended.
  • Transit Loss: The complete failure of the courier to deliver the parcel to the designated Delivery Address. A parcel is deemed lost when it remains unreceived at the Delivery Address for at least twenty-one (21) consecutive calendar days following the Scheduled Delivery Date. Upon reaching this 21-day threshold, priority resolution will be initiated without waiting for final carrier tracing reports.
  • Limits of Care: Transit Damage and Transit Loss are mutually exclusive remedies and cannot occur or be compensated in respect of the same parcel. At our or the Merchant's election, resolution shall be effected through item repair, replacement, or reimbursement up to the Total Transaction Value.

RESOLUTION PROCEDURES AND REQUIREMENTS

  1. Mandatory Submission Deadlines:
    1. Transit Damage: All requests must be formally submitted within fifteen (15) calendar days of the courier confirming delivery. For concealed damage, issues identified within this 15-day window are presumed to have occurred during transit. Any damage or loss discovered sixteen (16) calendar days or later post-delivery is deemed to have occurred outside of transit and is not eligible for resolution.
    2. Transit Loss: Requests must be formally submitted no earlier than twenty-one (21) calendar days after the Scheduled Delivery Date, and no later than sixty (60) calendar days from the original carrier dispatch date.
  2. Evidence and Cooperation: Applicants must retain damaged items, inner protective material, and outer shipping boxes until review is concluded. Submission of clear photographic proof of damage, carton conditions, shipping labels, and product serial numbers may be required. Failure to furnish reasonable documentation may result in request denial. Where requested, damaged property must be returned using a provided pre-paid label prior to replacement or refund release.
  3. Remedy Execution: Reimbursements are remitted solely to the original checkout payment method, or via secure electronic disbursement directly to the verified purchaser email address. Disbursements will not be redirected to alternative accounts or third parties.
  4. Resolution Channel: All Expedited Resolution Requests must be initiated online via our designated support portal at surecircle.net/support. Inquiries may be addressed to: SureCircle LLC, 17350 State Hwy 249, Ste 220 #30038, Houston, TX 77064, USA.

PAYMENT, PERFORMANCE, AND RIGHT OF WITHDRAWAL

  1. Immediate Performance: By adding this Service at checkout, you expressly request and agree that service execution commences immediately upon parcel packaging and transfer into courier custody.
  2. Waiver of Withdrawal: You acknowledge that the primary performance of this Service comprises active transit monitoring and priority risk absorption from the moment of dispatch. Once a parcel enters courier transit, performance is deemed fully executed. Consequently, you waive statutory withdrawal rights, cancellation periods, and rights to refund of the Priority Care Fee upon courier intake. The Priority Care Fee is non-refundable once transit commences.

GENERAL PROVISIONS

Geographic Scope & Sanctions: This Service extends to domestic and cross-border deliveries, but strictly excludes shipments originating in, routed through, or destined for countries or regions subject to comprehensive trade sanctions or embargoes administered under applicable national laws or United Nations mandates.
  2. Anti-Double Recovery: Double recovery is prohibited. If financial reimbursement or replacement has already been received from the Merchant, courier, or payment provider for the same transit incident, rights under this Service are deemed waived. Initiating an unauthorized payment dispute or chargeback following completed resolution constitutes a material breach of this Agreement.
  3. Governing Law and Forum: This Agreement is governed by the laws of the State of Texas, United States, without regard to conflict of law principles. For consumers habitually resident in the European Union or the United Kingdom, mandatory consumer statutory protections and local judicial remedies of your home jurisdiction remain fully unaffected.
